Terms of Use

These terms apply when you use Magicly — the mobile app and the website at magicly.ai — operated by Retomagic (“we”, “us”). By creating an account you accept them.

What Magicly is

Magicly generates images and video from text prompts using AI models we access through third-party providers, and lets you publish the results to a shared feed where other people can reply to them with generations of their own.

Your account

You need an account, created by signing in with Google or Apple. You must be at least 13 years old, and old enough in your country to agree to these terms. You are responsible for what happens through your account. One person, one account; do not share it.

Your content

The prompts you write and the generations you make are yours. We do not claim ownership of them.

When you publish a post, you give us permission to store it, show it to the audience you chose, and include it in the feed and in search and recommendation surfaces inside the app. You also allow other users to remix it — to start a new generation from it — unless you switch remixing off for that post. This permission lasts as long as the post is published. Deleting a post also removes the remixes other people made from it — a remix lives in the thread under its original, and the thread goes with the post.

You are responsible for what you upload and what you publish. Do not upload a reference image you have no right to use, and do not publish anything that infringes someone else’s rights.

What AI output is, and is not

Generated content can be wrong, strange, or similar to someone else’s result from a similar prompt. We do not promise that a generation is unique, accurate, or fit for any particular purpose, and we do not promise that a given model will keep behaving the way it does today — the providers behind them change without notice.

Whether you can use a generation commercially depends on the terms of the model that produced it. Check them before you rely on one.

Rules

Do not use Magicly to create or publish:

Sexual content involving minors, or anything that sexualises a minor — this results in immediate removal and a report to the authorities.

Sexual or intimate imagery of a real person made without their consent.

Content that impersonates a real person or organisation in a way meant to deceive, or that presents a fabricated event as real.

Content that harasses, threatens, or incites violence or hatred against people.

Anything that breaks the law where you are.

Do not attempt to extract our source code, scrape the service, resell access to it, or work around the generation limits.

Moderation and enforcement

Prompts are screened before a generation runs, and generations may be marked as adult content, which limits where they appear. Users can report posts and accounts. We may hide content, restrict an account, or close it, and we may do so without notice where the content is illegal or the harm is immediate.

Free use, credits and Pro

Several models are free to use within a daily limit that resets each day. In the mobile app, a free generation may require watching a rewarded ad first.

Other models are priced in credits, and the price is shown before you start a generation. Credits are deducted when a generation is accepted. If a generation fails on our side, the credits are returned; if it completes and you dislike the result, they are not — the work was done.

Pro is a paid subscription. It raises the daily free limits and grants a monthly allowance of credits. That monthly allowance refreshes each month and does not roll over. Credits you buy separately do not expire while your account is open.

Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.

Payments, renewals and refunds

Subscriptions bought in the mobile app are billed by Apple or Google; subscriptions bought on the website are billed by Stripe. A subscription renews automatically until you cancel it, and you cancel it where you bought it — in your App Store or Google Play account, or through the billing page on the website.

Refunds follow the rules of whoever took the payment: Apple, Google, or Stripe. If a charge looks wrong to you, write to us and we will help sort it out.

Prices can change. A change never applies to a period you have already paid for.

Availability

We may change, suspend or discontinue any part of Magicly, including individual models — the providers behind them sometimes withdraw them with no notice to us either. We try to keep the service running, but we do not guarantee it will be available without interruption.

If we close your account for breaking these rules, unused credits and the remainder of a paid period are forfeited.

Liability

Magicly is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost content, or for what third-party model providers do with a prompt you sent them. Nothing here limits liability that cannot be limited by law.

Changes to these terms

We may update these terms. The effective date at the top of this page changes when we do, and we will tell you in the app about a change that materially affects you. Continuing to use Magicly after that means you accept the new version.
